Visitors are requested to go through the Membership Plans Terms and Conditions of ToyExpress.In for availing rental services for toys/books/puzzles/board games.
ToyExpress.In reserves the right to update the Membership Plans Terms and Conditions from time to time, with or without prior notice. The updated version of Membership Plans Terms and Conditions can be reviewed by clicking on “Membership Plans Terms and Conditions” tab located at the bottom of the Website page. The updated version will supersede all previous versions. Use of the Website after updations made implies that the user has agreed to the updated version.
Toys rented/circulated by ToyExpress.In can be/are in “used & in new-like” condition but are rented out in sanitized and safe condition. However, there will be no guarantee of brand new toys being delivered during Toy/Books/Puzzles/Board Games rental cycle.
ToyExpress.In items being rented out to customers may have scratches on them to the extent that the functionalities of the item are not affected.
ToyExpress.In will not be responsible for any damages or injury to any person or child as a result of use or misuse of its toys or property. We make no warranties of any kind, express, implied, statutory or otherwise for any service we provide.
Members Of The Library
Members are those who register themselves with ToyExpress.In by completing the registration process to avail our services.
Refundable Security Deposit
Members must pay refundable security deposit to ToyExpress.In based upon the subscription plan chosen by them. Members will not receive any interest on this deposit. This deposit will be refunded when the members terminate the membership after deduction of dues (if any) to ToyExpress.In.
Registration Fee
All people willing to enroll as a member of ToyExpress.In have to pay a non-refundable registration fee of INR 300/- .
Re-Opening Fee
In case of a closed account an activation fee of INR 200/- will be levied along with other charges to re-activate.
Note: - No additional fee will be charged incase the account was in “Freeze” category.
Membership Fee
To avail the services the members can choose a plan based on their requirements from the available list of Plans under the “Membership Plan” category. Products can be borrowed online after selection of the Membership Plan, however, delivery of selected products will be done after realization of the applicable fees(which includes onetime registration fee+ Security deposit + Membership plan fee).
Special Additional Rental
For certain high value products or high in demand products(as determined by ToyExpress.In) there may be an additional fee charged to the members which will be intimated beforehand.
Renewal of Membership Plan
Membership Plan can be renewed any time by a member. The renewal plan can be one of any plan offered under the “Membership Plan” section.
A reminder mail will be sent 1 working day prior to the expiry of Membership Plan on the registered email id. In case there is no response for upgrading to another plan/freezing the account/closure of account within 2 working days from the mail sent the plan will automatically get renewed to the existing plan and applicable fee will be charged.
The membership is valid depending upon the date of enrolment and membership plan chosen by the member. Members may extend the validity period by renewing their membership for further period. ToyExpress.In will extend the validity after realization of the applicable fees.
Renewal of Membership Plan or Extension in the duration will be counted as a transaction.
ToyExpress.In has the right to change/revise/modify the Membership Plans at any time without giving prior notice. However, in case of modification of plans, the same will be applicable to existing members only at the end of validity period of existing Membership Plan.
All products in circulation will continue to remain the property of ToyExpress.In.
Any change in address needs to be communicated to ToyExpress.In.
Members are not allowed to exchange toys with friend even if they are members of ToyExpress.In. All toys must remain at borrowers home.
Delivery/Return Instructions
The maximum number of times that a member can borrow products from ToyExpress.In in any 30 day period will be as per the plan chosen from the “Membership Plan” category. In case, a member borrows less than the number of prescribed times in 30 day period, the balance will not be carried forward to any subsequent 30 day period. For e.g.: if a member borrows only 3 times in a month however as per their plan they are eligible for 4 deliveries , then he/she cannot carry forward the balance 1 to any subsequent period.
Any additional delivery other than the part of the membership plan or in response to the complaint received will be charged extra.
Members are requested to count the number of piece(s)/ check the quality of the toy at the time of delivery. In case of any disconnect please get the same recorded on the “Issue Form” available with the Delivery Boy. The issue form will be considered as final at the time of return of item as well.
Members cannot claim any compensation in any form from ToyExpress.In in case of delay in home delivery/pickup of any product and also in case of non-availability of any product in circulation.
The Home Delivery Agent of ToyExpress.In will also check each product thoroughly at the time of return to check for missing parts and whether the returned product is in the same condition as it was delivered as per the “Issue Form”. Members are requested to ensure that the items returned are cleaned for any visible debris (i.e. food, dirt etc.) before returning back.
Post return all items go through rigorous Quality Check by the Quality team, in case any damage/missing part/functionality issue is highlighted, it will be intimated to the member by the next working day through email / sms.
In case of missing part the member can return the same within 15 days failing which an additional charge will be levied depending on the repairability/availability of the missing item. In case the item is beyond repair depreciated cost of the toy will be charged and the same will be intimated to the member through email /sms.
Please make sure to return all the pieces of the toy at the time of return of the last toy.
In case, the missing pieces are found later and need to be picked up by ToyExpress, then an extra delivery charge of RS 236 will be charged or the member can send to our office premises.
Any complaint regarding the functionality of the borrowed item must be received within 24 hours of delivery for it to be considered as a valid complaint. Appropriate measures will taken by ToyExpress.In team to rectify or exchange the item without any additional charge to the member. However, under no circumstances will a compliant regarding an item be acceptable beyond 24 hours of delivery, the same may be charged to the member at the discretion of the company.
Procedure for closure of Membership Account
In case a member wishes to close their membership account a written communication via email should be emailed at accounts@toyexpress.in before the membership plan expires.
Based on the request received the toy/puzzle rented out to the member will be picked up and will sent for quality inspection.
The membership closure request received will be processed within 7 working days for approval from Management.
The refundable Security Deposit will refunded via cheque(in case payable) to members within 15 working days from the day of the Management approval received after adjusting any previous pending payments arising due to damage of returned toy/any pending membership plan payment.
Payment Refund/Adjustments
Registration fee and Subscription fee once paid are non-refundable under any circumstance.
ToyExpress.In reserves the right to stop/delay any issued payment in case of any discrepancy countered at the time of final closure/return of items.
Jurisdication
All disputes will be settled in the courts of New Delhi City only.
